Important Legal Notice for Equinox Distributors

If you became an independent Equinox distributor between January 1, 1991 and January 7, 1997, the following information may be important to you in asserting or preserving your legal rights.

As you may know, Equinox International, Bill Gouldd, and Advanced Marketing Seminars, Inc. are facing suit for running an illegal pyramid scheme. The lawsuit is pending in the US District Court in Las Vegas, NV. Plaintiffs are the Federal Trade Commission, the states of Hawaii, Maryland, Michigan, Nevada, North Carolina, Tennessee and the commonwealths of Pennsylvania and Virginia.

If you joined Equinox prior to January 7, 1997 and you wish to be a party to the class action suit, you need do nothing. If you remain a class member, any claims you may have against the defendants relating to the subject matter of this suit will be determined in this case and cannot be presented in any other lawsuit or in any other forum. By remaining in the class, you will not be obligated to pay the costs of the litigation.

If you wish to be excluded from the class:

  1. You must send a written request for exclusion to the following:

    Garden City, NY 11530-9355

    You must mark "Request for Exclusion" on the outside of your envelope. You must mail your written request for exclusion on or before March 31, 2000 and you must set forth (a) your name, present address, and telephone number; (b) the name of the litigation, Lowrance v. Gouldd; and (c) a request that the court exclude you from the class. If you ask the court to exclude you:
  2. you will not share in any recovery that the defendants might pay to class members as a result of trial or settlement of this lawsuit;
  3. any decision in this lawsuit favorable to the defendants will not bind you; and
  4. you may present any claims you have against the defendants by filing your own lawsuit, or you may seek to intervene in this lawsuit.

If you opt to remain a member of the class, the court may require you to prevent evidence regarding your payments to the defendants and your Equinox income, if any.
