Netco, Inc., et al. v. Jimmy Dunn, et al. Plaintiff R.K. Kelm, Co., L.L.C. has dismissed its claims in the above-styled lawsuit without prejudice. The other plaintiffs are proceeding to litigation. Backstreet Publishing, publisher of Amway Motivational Organizations: Behind the Smoke and Mirrors by Ruth Carter (this site owner), was subpoenaed in an attempt to gain information about Ms. Carter and about the book's sales. An objection was filed. Scott Larsen, , subpoenaed in March, 2000 with essentially a duplicate of the subpoenas sent last year to Wilkes, Hoagland, Midgett et al. Larsen complied with the subpoena, was paid a fee by Amway. In October of 2001, according to Larsen, his site was shut down after an Amway attorney threatened his ISP. John Hoagland: Hoagland agreed to search terms and turned over the entire contents of his computer hard drive to Amway's representative. Was paid a fee by Amway. MPINet, John Hoagland's ISP. Unknown. Dave Midgett: Midgett filed a motion to quash the subpoena, and removed and stored his hard drive pending a decision. On May 17, 1999, the judge refused to hear oral arguments and ordered Midgett to comply. Ashley Wilkes: Wilkes filed a motion to quash the subpoena, and the judge ruled in his favor. Amway requested the judge overturn his decision, and the judge ruled again in Wilkes' favor. University of Minnesota (Wilkes' employer): successfully blocked Amway's access to Wilkes' work computer and the University's computer records. Round Two: After adding Schwartz and Lowndes as defendants, Amway again subpoenaed Wilkes' hard drive and documents. Worn down by burdensome legal expenses, Wilkes has agreed to turn the contents of his hard drive over to Amway, and removed his site from the internet. After an absence of several months, he put a portion of his site back up. It has since been removed again. Kenneth L. Lowndes: Lowndes filed a motion to quash, judge ruled against him. He is appealing. Sidney Schwartz: Schwartz filed a motion to quash the subpoena. Because Amway is petitioning the Michigan court to add him as a defendant on their suit against P&G. On May 14, 1999, the Oregon judge denied Amway's Motion to Compel. Diana Dbrunjes: Complied with subpoena.
