The State of Florida alleges that The Winner's Circle is conducting an illegal pyramid sales scheme, and is engaged in unfair and deceptive trade practices. A temporary injunction has been granted, which "essentially freezes the assets of The Winner's Circle and orders them to preserve and maintain their records," according to a spokesperson from the prosecutor's office. "We are also asking the court to appoint a receiver to look at the business operations," and the State expects the court to grant this request.

The Winner's Circle has made no formal, legal response as of yet.

The injunction will stand until the case goes to trial, or until The Winner's Circle enters an agreement with the State of Florida to cease its unfair and deceptive trade practices, and to stop conducting the illegal pyramid scheme.

A multi-level marketing business must receive the bulk of its income from sales to end consumers, rather than from recruitment of distributors, in order to comply with Florida law.

According to the prosecutor's spokesperson, "We have issued subpoenas to the Winner's Circle in the past and they have been unable to substantiate sales of product to our satisfaction."

The state has received "dozens and dozens" of consumer complaints about The Winner's Circle, and estimates that 6,000 Florida residents have been victims of this scheme. The dollar amount of consumers' losses is not known at this time.
